Yes, it is able to change powers while being touched, and yes, it would be able to do that. The likeliest result, if someone picked up Taliar's soul and didn't put it down for three days and had no special circumstances such that his soul was inclined to be friendly to them about it,* is that as soon as the powershift interval was up that person would be abruptly incinerated.

*this covers "being a Maitimo" but also, say, "having been coerced into it" or "not knowing what soul-touching does".

And how likely would it be to recognize some of the non-Maitimo circumstances? And presumably that power would stick around for a bit and would recognize whether future touchers had special circumstances?

It would be conservative about the incineration and would use gentler methods where there was any doubt about how voluntary and informed their actions were.
